Safer if you live in the US, more convenient, too. I was mostly thinking about the US music companies, who can't be bothered to look up Japanese titles to see if it's a musical artist (they might have licensed), a random name, or possibly the title of an anime. It's like comparing Japanese fansubs and Chinese bootlegs to rips of English-dubbed US episodes and bootlegs (seen these lately, based in Illinois, of all places). If I were distributing entire copies of anime, I'd be much more worried about the licenses in the country I live in, than I would about foriegn countries. But since we're talking amvs, we already know Japanese anime groups see it as free advertising. Until they change their mind or sell their rights, they're the only ones whose anime we can safely use.
They might frown more on seeing us use the anime music along with the footage, but they still have no precedence of cracking down on fanvideos using their content. Unlike certain US recording labels.
So, yeah, safer. As safe as using really old or unknown artists. I could make a dozen videos using one of Bobby Darin's songs, but who would they say I took it from? He's been distributed by at least six recording labels over the years. They'd have to prove which one I took it from, make sure that's against that label's policy, and make sure they get paid enough for attacking little me for it to be worth their while. Highly unlikely. It's even safer when the owner is in a whole 'nother country and happily looking in the other direction.

If you can make a good AMV with anime music, even from the same anime as the video, then have fun!
