are amv legal or illegal ?

distributing or presenting amvs to a public audience without permission from the copyright holders is illegal. breaking css on a dvd is illegal.

but as far as i know, rearranging video sequences and attaching music to the edited video is not illegal.

if you are interviewed, you can talk about the editing part itself without incriminating yourself. just don't mention distribution or ripping dvds.

Well, actually, my friend found some idea... If they would play only some part of my amv's, not all amv's, than there will be only part of music... So is it still illegal? Althou there is still problem, because they can ask me only one bad question, and I'm down... "Is it legal?", "Do you have legal software(Premiere, AE)" and I'm dead.....

you should gear more towards creation, and creativity, and shy away from illegal things..

maybe mention other things that involve the community: like contests, multi editorer projects, ect.

if this tv program is a news report or a documentary, then they may be able to do that under fair use. it'd be better to consult someone educated in law though.

and dude, if you are in Poland, your laws will be different that they would be from probably the majority of folks here at the ORG (which I am assuming is US, if not, please forgive). If AMV making is legal, or illegal here in the US probably makes no bit of difference if it's legal or not in Poland.

maybe you'll have to do your own research for Polish law...

I already did inthe same time, when I created this topic. And it looks like, the Polish law is pretty similar to the one in US..

Here's the offical verdict on music videos and copyright.

§ 1101. Unauthorized fixation and trafficking in sound recordings and music videos
(a) Unauthorized Acts. - Anyone who, without the consent of the performer or performers involved -

(1) fixes the sounds or sounds and images of a live musical performance in a copy or phonorecord, or reproduces copies or phonorecords of such a performance from an unauthorized fixation,

(2) transmits or otherwise communicates to the public the sounds or sounds and images of a live musical performance, or

(3) distributes or offers to distribute, sells or offers to sell, rents or offers to rent, or traffics in any copy or phonorecord fixed as described in paragraph (1), regardless of whether the fixations occurred in the United States,

shall be subject to the remedies provided in sections 502 through 505, to the same extent as an infringer of copyright.

(b) Definition. - As used in this section, the term "traffic in" means transport, transfer, or otherwise dispose of, to another, as consideration for anything of value, or make or obtain control of with intent to transport, transfer, or dispose of.

(c) Applicability. - This section shall apply to any act or acts that occur on or after the date of the enactment of the Uruguay Round Agreements Act.

(d) State Law Not Preempted. - Nothing in this section may be construed to annul or limit any rights or remedies under the common law or statutes of any State.


For those who got confused, this means if you intend on using the music and video for profit then it's illegal.
Otherwise there is no problem with making music videos.

dude just think of anime conventions, they have amv's do they not? Its not illegal as Older_gohan said.

Cons (and/or the venues they are held in) pay for liscenses to play the music contained in the videos as well as any music they may have at a dance.
