I sent a copy of the article to my brother in Miami (he's a political science major studying to be a D.A.) This is his response:
Ceteris paribus, I might call this anecdote
"unbelievable." But, given that these events took
place in Texas, "things are not equal," in the words
of Mr. Spock. Wierder things have happened. Try
asking any professor up there who does study on the EU
about the "German Sex Dolls Case," in which the ECJ
established the doctine of mutual recognition. I
doubt the Supreme Court will hear this one. It looks
as though their plate is pretty full already for this
particular year, and in any given year, they only hear
maybe 100 and change cases out of about 7,000+
petitions that are sent to them. However, I must
agree that the prosecution's arguments in this case
fails the so-called "Straight Face" Test. The basic
problem is one inherent in all obscenity cases: that
obscenity is extremely difficult to define. U.S.
Supreme Court Associate Justice Stewart probably gave
the best definition: "I know it when I see it."
