Boochsack muted my video

I don't know what I'm supposed to do. I created a video back in 2004 and I wanted to share it with people because I just found it again and I thought it was funny. Not as good as some of the videos I've seen by far, but still I thought people might enjoy it. It has "Soul to Squeeze" by Red Hot Chili Peppers as the song and it's an Inu Yasha video. I was really disappointed when I saw that my video was muted.

Where can I upload my AMV to share it? I really believe that everything in my video is fair use.

You probably can upload it here. Here's a good step-by-step from Nya-chan Production:

Nya-chan Production wrote: step 1: get FireFTP
step 2: install it into your Firefox
step 3-5: Go into "upload a video", request new upload, right-click the address and select "Open with FireFTP in the new tab"
step 6: navigate to your amv in the local site window/area, then click the green arrow to transfer the file
step 7: grab a glass of white wine, or other drink of your choice...but if you want it to work you'll get white wine. Drink said wine while it uploads.
step 8: close the tab, and go back to your member's main page
step 9: where it once said "upload video" the button should now say "confirm video." Go through this process

1. Only judges can decide whether or not your video is in fair use.
2. You're using Youtube's servers for free. Of course youtube has the right to do stop serving the content of your videos.
3. Fair use is not a right, only a legally defensible position.
4. Copyright law stinks.

Whether or not AMVs are actually legal is not yet tested in court. Soo... until that time, all I can say is that I don't know whether or not it is legal. Further, I'm not a lawyer, so don't take my word as legal advice :-p

I can pretty well bet you that the vast majority of AMVs are illegal. Some easily fall under parody and a few may even be able to be defended as educational to some degree, but most are just there for entertainment and would likely not be protected under fair use.

Though if have enough money, feel free to take it to court and find out once and for all. It'd probably be a nice long case and I'd be curious to see how it turns out. :P

i believe you can use fair use to argue for creating the video, however sharing the video doesn't fall under fair use
