and boy am I glad, I didn't even know about you or your videos, And I realy liked this one.

As for the guy taking your footage, its actually alot less than 60%. You can tell where he might have taken it directly from your video since those parts have that odd aspect ratio that I thought was the only weird thing about your video. The parts he either did himself or stole from soneone else (who knows) have diferent aspect ratios. Considering, IF he did the rest himself, I'd consider it a compliment that he'd take your footage, especially since he doesn't seem like a *bad* editor. I'd talk to him and make sure, Its posibble he only got inspiration from your vid, and decided to use similar scenes in his, and didn't actually copy it. Not defending him mind you, just comenting based on whay I've seen between the 2. I try not to take sides on these matters and analize it from both sides. Enough of his video is diferent that it can be given the benefit of the doubt, so its unlikely he'll be banned unless you can prove it more concretely. I'd ask for a screenshot of his timeleine from the creator to prove his innocence (if there is any innocence) if its a big deal to you.

On a side note, I did like your video better.

Ok, fine... I'll prove it then.

Being the creator of the original, perhaps I can see exactly what was stolen that others might miss. Here's a list of everything that was taken from my mvid - marked in mins/secs on his mvid.

:21 - That's mine. I remember the On Your Mark DVD was fairly tricky and I had to lengthen that scene since it cut off right after the wing was lifted - so I had to freeze it to make it fade out to the music; although it's at a different position in the song, it's still mine - I could recognize my work anywhere.

:33 - :48 - If you guys don't see the obvious similarity here then I don't know what to tell you ;\

1:34 - 1:39 - Direct rip from me. If you go through the scenes frame by frame you will see that my mvid of the angel in On Your Mark starts almost exactly at the same point his does. Also, when the angel is flying up he fades it out before the other scene in my mvid can appear (Laputa scene).

2:17 - 2:26 - Good god.... this person ripped an entire sequence off of me. This part is the one I'm most pissed about. I spent *forever* trying to get this scene to fit in with my original. It's the *exact* same one as mine is. Same editing, same sequencing. If this guy 'copied' it then I'll say thats bull because I know my own editing. This is a direct *rip* if I've ever seen one...

2:27 - 2:33 - Not the same sequencing as I used but close enough that I would clearly notice it. He might have used my sources, he may not have. I personally can't tell with the grainy footage. However, I used HK DVD rips for all the eva scenes. I'm almost positive that the official dvds are anamorphic... I could be wrong tho....

2:34 - 2:45 - Used the same parts I did in this scene. A few new ones added, but he still used the events of Kenshin slashing Tomoe.

3:08 - 3:16 - Just like the AMG one. Directly ripped from me. I did a comparison and every frame is there.

3:22 - That part with Faye is iffy. Looks like mine but it's scrunched up so badly I can't tell....

3:40 - End - Dear lord... Used half my ending for this mvid too... Obviously since he wasn't using Video Girl Ai for footage, he stuck in the Eva scenes as well as some others. Still, this ending is almost identical to mine (with a few scenes changed).

*sighs* As I've said before, the original creator is the one who knows best. I spent three months on 'World Turned Over' and to have it butchered and ripped like this... *shudders*

Perhaps I'm being too biased. Perhaps this 'creator' needs me to pat him on the back and tell him it's 'ok' to do this kind of thing to others in the future? I don't know about you guys, but I'm sure if something you worked super hard on was taken, cut up and claimed as someone's own and not yours, you'd be pretty pissed.

The point is that he stole what I made (altho it doesn't *legally* belong to me) and in doing so he's soiling what us mvid creators strive for - individuality and originality.

I still stick with my previous accusation that he took more than 60% of my mvid. He didn't just take scenes, he took my idea and my hard work. If that doesn't count for 60% then I don't know what does...

Now don't take this the wrong way, but it might be better for you if you *didn't* flame him right away. That puts the person on the defensive, or worse, righteous and spouting the old 'you don't own it either' bit.

Instead, try playing 'nice' about it - explaining that when you take footage you need to cite that footage. Be helpful and tell him what he needs to do so he won't get in trouble on the org - cite his source the way everyone else does. Tell him that you're sure he didn't realize anyone would get upset, and that you know he didn't mean any harm, but that what he did really isn't appreciated - but that he can make ammends by asking permission next time - or if that's not an option, merely crediting the person whose work he used in his own vid.

If you just go and accuse and threaten him, then it's going to look bad on you when the org doesn't act on your threats. If you warn him (as a friendly editor) and tell him what he needs to do without saying outright that he'll get banned (just explaining that this sort of thing is frowned on and can lead to all sorts of bad things), then chances are he'll get worried or guilty about it. At best, he'll request the vid be deleted. At worst, he'll ignore you. But threatening that he'll be banned is going to make him do it again once he realizes your threats were groundless. He'll turn an indignant "say what you like but I know they won't do anything to protect you so just keep yapping and I'll keep stealing". The idea is not to give any ultimatums, nothing that he can test.

The org's policies on plagiarism (which is what this is since he didn't directly copy the *entire* video) are very weak. They won't ban him. They can't make him take it down. And you telling him they will, in a hateful email, will just show him that you don't have any backing for your threats. You don't want him to know that. So play the nice person warning him before he gets in trouble - chances are he'll believe you. As long as he doesn't know any better (as long as he doesn't put your threats to the test and realize nothing will happen to him).

And if you haven't seen it, there's a long thread in the 'site help' section about this very thing. ^.~

We're not arguing on the point that he stole your work which he did so theres no need to argue the point O_o.

I agree

I'm saying he took 60% less of your footage, hard work yes and Idea but I wasn't arguing against the either so...

Himiko listen to me I know what he did was wrong and you were screwed over because of what he did and he is totally at fault. I'M NOT DISAGREEING WITH YOU.

YOU ARE RIGHT

Well thats true, I didn't consider that. Still I also agree with Arigatoumyna, don't be nasty to him/her yet. Try it the nice way first. Then if he doesn't comply, Don't do anything else with him yet, Talk to the mods. Try to get them to act on it first. THEN if that doesn't work, Do whatever else you want to do to the bastard to get even.

Just keep in mind, Flames usually only serve to make the fire hotter and usually doesn't actually solve anything, but rather make it worse. Alot of times it makes both parties look like idiots too. Just tryin to help.

I'd prefer Himiko to try and contact the creator and get them to retract the video. If the creator is an ass about it then we'll forcably remove the video.
