Yes, and I aknowledged that in my original post. There is no way you can claim Whisper Of The Beast. It's too well known. In this case my complaint was that the video has been altered by cutting of one third. The viewers might get an impression that this is all of it. I was writing a properly long-winded response to Esc's numbered post, but then a whole bunch of people replied afterwards and most of it became redundant and there is really no point in spending so much time refuting Esc since after all, he is the victim here.
Anyways, here is the text from our Site FAQ concerning stolen videos:
This thread will stay open so that people may, if they so choose, look at the other videos and see if they perhaps recognize their own or other people's work as there are a lot of videos out there and our staff is not guaranteed to have seen them all.
In short, the moral of this thread should be:
Vigilantism = bad
Private investigation = okay
Anyways, here is the text from our Site FAQ concerning stolen videos:
For first-time offenders, we simply remove the video. If they continue to steal other people's videos, we may revoke their upload privileges or ban them outright. However, it depends on the situation. First of all you should contact the member about it. Quite often videos are "stolen" unintentionally by members who do not understand how the site works and enter videos that they have seen rather than ones they have made. If contacted then they may remove the video themselves.

Someone has stolen footage that is obviously from my video, what should I do?
This is a more difficult situation and there are many different ideas about how to handle this. On the Org, using someone else's pre-edited footage without acknowledgement is considered rude. You should contact the video creator and ask that you be properly credited for the editing work you did on the source material.
If however, the user does not want to credit your work, please give full details of the video, the alleged stolen source and your e-mail contact to admin@animemusicvideos.org and the issue will be looked into. Decisions will be made on a per-video basis. If someone has actually taken your entire viedo (or at least the majority of it) and is claiming it as their own then contact us at admin@animemusicvideos.org with all the details and we will see about having the offending video removed.

I find it highly amusing when people advocate draconian, zero tolerance policies for AMV theft, apparently unaware that AMV creation is, from the right perspective (i.e. the perspective of the firms that hold the copyright on all the source material you rip off), just as despicable.nmaster64 wrote:I say burn him at the stake, or crucify the guy. First off, everyone should realize I was exaggerating a bit with my last post. I do however believe people who purposely claim other people's work should be banned.
1) A multimillion dollar company releases a product, while viewable for free, alongside highly overpriced merchandising.
2) A fan creates a piece of art, not claiming the source to be his own, but simply as a compliment to it, for free for all to enjoy. What most don't realize is these fanworks serve as great ads to the show, and create more fans, selling more merchandise.
3) Another fan takes the previous fan's work and claims it as his own, receiving all the credit for it without any of the work.
So guess what? Newflash! The only person who suffers here is the original fanwork creator who slaved for hours over a fanwork all for nothing. The theif gets the fanfare he desired at no cost, and the source creators get money anyway you go about it.
The fact about fanworks such as AMVs is this: the creators have already seen the episodes. They know the series up and down. They generally are the big purchasers of the merchandise. However, they should then shell out hundreds of dollars for DVDs just so they can create an AMV that essentially serves as one awesome advertisment for the show? Ridiculous.
There's no "ripping off" involved in AMV creation, because nobody claims they actually made the anime or music that they're using. Credit is given where credit is due.
