quick q's - making money out of copyrighted material

Quick simple questions related to video game music videos and video game footage...

Ok we know anime copyright holders are fully legally entitled to protect their material, but most if not all turn a blind eye to amv's nonetheless.

1 Can the same be said of video game footage? I mean do the copyright holders have the same entitlement to protect their footage.

As any infringement is conditional depending on things like "fair use" and maybe other factors, lets use the video game footage from this specific example: http://www.shoryuken.com/?page_id=65

2 Is it fair use? Thus are they legally entitled to make money off it? Or the copyright holders of the vieo game footage still have the ability to intervene at any time but don't?

Well, they're asking for DONATIONS, not charging a mandatory fee.

A better example would be the sale of Red vs. Blue DVDs - in this case the Rooster Teeth crew has the blessing of both Bungie and Microsoft, so it isn't an issue.

Seems to me they are reluctant to highlight the "donation" part and put much emphasis on "how to purchase" and state "you are not allowed to redistribute" (which is strange for two reasons imo).

Nonetheless, that is an issue of their marketing, could they still legally sell dvd's if they wanted to, does the material fall under fair use (unlike amv's)?
