First off, an excellent video. I was very pleased with both the craft, and thought that went into your effort. Exceptional considering the materials available. It'll be a long while until someone tops that one.
As for the legalities.. I vote it as kosher.
It's covered under fair use. Still, Disney won't bother you because A) It's promotional... it is not being used in a manner which it's used to use the entire movie. Disney may not ask people to promote their stuff... but they certainly don't gripe about it. B) Anime is their "New Market", so they need all the fan support they can muster. Bothering people who make AMVs is a big no-no in that respect. C) Disney got in hot water for suing a Daycare Center for using their intellectual property on their mural inside... where children can see it. They got a buttload of flak over it. They aren't going to rock any boats. They're on shakey ground as is.
As for the bootleg issue.. that's hardly an issue. AMVs are technically illegal as hell anyway, using music the users didn't pay a royalty fee on. It's only because creators include song information that people don't make a stink about it. Sufficient information about the movie, song, and artists involved were displayed in the description to show that it is intended to promote them, not exploit them.
But to appease Dokool... DVDs made in non-copyright abiding countries (China, Taiwan) are perfectly legal. Morally illegal maybe, but 100% legal to be sold on store shelves, online, and elsewhere. Considering the girl is a fan, and would obviously buy a real release if it was available... there's no reason to wait. It's covered under several clauses.
Also, owning bootlegs is not illegal. Selling illegal ones is. The law is quite clear on that matter. It's also clear on what is considered an illegal bootleg.
Did you honestly think the bootleggers at anime conventions snuck in there and set up ILLEGAL shop? Heh... it may be trendy to snub their stuff, but they have every right to sell it. In raw form up until a commercially available version is available for purchase, and if it has chinese or taiwanese subs... indefinitely. No laws against subtitling it either. Fan subbing is technically legal in this respect as well.
Considering that anime has never had Macrovision protection so that fans could create fan made videos off the tapes is also a clear indication of how the anime companies feel on the matter. They want people to make AMVs... always have since the days when people had two VCRs and a stereo involved in the process. They know we'll buy it when it gets released... and see it if it's in the theaters. They also know that it's far better to let the fans advertise for free, than spend millions on tv commercials...
When Howl's Moving Castle comes stateside... there will be a lot of support for it if the fans advertise it sufficiently. I sincerely hope they do, as it's a brilliant piece of work. Possibly Miyazaki's most interesting piece since Nausicaa.
