as much as i enjoy this witty back and forth. i just wanna say.
1. if you read the email i sent the first words were i run a tiny indie label.
2. after i emailed the first person who's site i went to. he actually took the time to email me back. and suggested that even though he was very busy that i go through the links on his page and someone there should be able to help me. so that's what i did.
3. there is no profit directly to be made off of this video it is for promotional purposes. we're not selling it. ghostface released an anime video for "daytona 500" as well as daft punk. they aren't illegal as long as you clear the usage of it from the company that created it. i've never personally tried to do it myself, and maybe you have are speaking from experience but as far as i know it's not impossible as other people have managed to make it happen.
4. i asked for an anime video and not some other indie video because i thought an anime video would look better with the content of the song i created.
now i might have followed the code of your medium by asking known creators, but from an outsiders point of view it seemed most logical to get the best results to ask the people that were most known for doing it. plus that is what someone suggested i do.
also as an outsider i wasn't really aware that this site here existed. but once i became aware i took the time to register and post. only to be berated repeatedly by you.
and knowing the circumstances of why and how things happened might be the reason i feel like i'm being attacked.
that being said.
great

That doesn't change the fact that you're trying to make money, making you a commercial entity.third earth wrote:as much as i enjoy this witty back and forth. i just wanna say.

The difference between your indie label and Ghostface or Daft Punk is that they have money. You don't. Hell, they have enough money to comission their own animation, and not just buy the rights to an already-existing show.third earth wrote: 3. there is no profit directly to be made off of this video it is for promotional purposes. we're not selling it. ghostface released an anime video for "daytona 500" as well as daft punk. they aren't illegal as long as you clear the usage of it from the company that created it. i've never personally tried to do it myself, and maybe you have are speaking from experience but as far as i know it's not impossible as other people have managed to make it happen.
As an outsider, you should have done some research into what we actually do and the environment in which we work in (that is to say, doing these videos for ourselves and VERY RARELY for a corporate interest). You might also have wanted to call up people like ADV and Bandai to see how much licencing the footage would actually cost.third earth wrote: now i might have followed the code of your medium by asking known creators, but from an outsiders point of view it seemed most logical to get the best results to ask the people that were most known for doing it. plus that is what someone suggested i do.

Because you *don't* know what the scene is about, you come off sounding like someone who merely knows that AMVs are regarded as "cool" and will sell records, who doesn't have any appriciation of the craft to begin with.

Doesn't change the fact that he probably paid for the rights to use it. You're a hip-hop producer, you should be familiar with royalties from samples.third earth wrote:ghostface's video was old speed racer footage.
Show us contracts from ADV, Bandai, Geneon, etc. saying that you have permission to use their footage. Then maybe you'll get some interest.

How old are you, anyway? 18? 19?third earth wrote:ghostface's video was old speed racer footage.
You're coming across as very inexperienced and very immature, trying to grasp at straws and "defend" your position in a way that a more experienced and worldly producer would know better than-- Hells, your position wouldn't even have been taken by someone more worldly.

i wasent going to post here, but i see that no one is looking in the right direction, so here is my $0:02
so lets set this up so that it makes more sence. and maybe it will help everyone.
i make music. im by no means good, like third earth here, but i DO make it. for fun no less, as i am also sure that third earth does. i have made a few songs, nothing to big, but yea, i made a few songs. makign up my own melodies too, not just rehashing some premixed beats that came with my sampler.
now, lets go path A. and on path A i make an AMV to my own song, using something like Trigun. do i call up ADV and ask them if i can? most likly no. should i? yes. has anyone here ever done that? not to my knowing, and yes, i know about AD and his Noir amv, not the same, they came to him. so yea, i did something i shouldent have done. i stole ADVs footage without asking them. now, their is not a single person here that would say that what i did was wrong. not at all. well, ok, so yea, it is wrong, but unlike what i see going on here in this thread, no one would think twice about it.
now, path B, i host my song. let people download it. give it out to all my freinds. put it up on mp3.com or something. just let people listen to it for fun. and by chance, someone here gets it, and is moved to make an AMV to it. course, as almost no one here does, they DONT ask me to use it, and i just happen to find it on local or something. now THIS amv is totaly wrong, not only did they not even ask me, they didnt ask whoever made the footage if they could us it. and again, no one would think twice about this. and hell, if i found one of my songs made into an AMV, id be very happy, exstatic even! but even if i was totaly outraged, would that stop AMVs? maybe done to my music, but all the stealing would still go on and no one would think twice about it.
now, path C. i made this song. i want an AMV made to it. but i cant, im just not moved by it. or what ever, i lost Premiere or something. for some reason i just cant, and so, i come here, and i post in the sudgestions forum about this song and that hey, maybe someone should make an AMV to it. this happens all the time. nothing seems to be wrong with it. weather or not im trying to make it big in the music indrustry, why is that wronger then paths A and B?
simple fact is, we are all already stealing footage, all the time. and the issues of this has been beaten to death a hundread times over. if you dont like his idea, then just dont post. jbone and dokool are both right, but third earth is likewise not at fault. what if aerosmith came here asking someone to make an AMV for them? would you bitch at them as much? and whats the difrence, that they have money?
curently i am waiting for a return email from ADV. i wanted to know from them just how much it would cost to buy the rights to use their footage in an AMV, a totaly leagel AMV mind you. when i get a responce, ill post it, as it would make intresting reading =P
in the mean time, let all artest be what they are. this guy wants someone to make an AMV to his song, is that so wrong? i say no, and i for one will at least listen to the songs he has before i just dismiss him totaly, and especaly on such losse grounds as "oh no, i might get sued if i made this AMV"
as if you didnt already know that with all your other AMVs

I haven't read this entire thread and my reply isn't based on it, but....
Does anyone else find it odd/funny that this is in the "AMV Contest" forum?

In both your A & B secenarios..no one is using the said vid to promote anything..it's been done for the personal enjoyment of someone.XenoDrake wrote:

The problem is..if I've been reading this thread correctly..it's not that he just wants an AMV made for this particular song..one that he'll keep on his HD or on CD for his own personal use. He wants one to be made to PROMOTE the band.
No profit directly from said vid..but profit to be made none the less. That in itself causes me to shy away from it. It's a little different when you get an e-mail or PM from an individual that asks you to make a certian song/anime combo because they think it'll work well (something like what our suggestion forum does in fact)third earth wrote:3. there is no profit directly to be made off of this video it is for promotional purposes.
As far as being sued..your right..any one of us on this site could be sued for what we've done. But the thing is..we're not taking a vid we've made and pretty much waving it in the face of someone who could do just that. Which is what I'd think using a vid for a bands promotional purpose could do.
(although if you take into consideration about the AMVs shown at cons, I suppose you are doing that in a way, but I've yet to see someone that's shown a vid at a con have something like that happen. I feel that anime companies that are at said cons tend to veiw things like that as free advertisement or as just fan appreceation, and they KNOW no money is being made off of said vids)
All in all...this just sounds like a risk that I myself wouldn't be willing to take.
