US Constitution: Testament of Law, or Bathroom Wipe?

Post by UrGrueSome » Tue Aug 05, 2003 12:02 am

As far as I know, there is absolutely no problem with video recording or photographing people in a public place. If this were the case, then you would hear about lawsuits every day against such institutions as: Television news stations, Newspapers, Magazines, Freelance Photographers, 13 year old girls with disposable cameras, etc etc.. And guess what.. nope you don't hear about any? Why is it that tabloids can get pictures of celebrities and use them whenever they want and not get sued? Hmm.. I wonder. Could it be the the first ammendment of the Constitution of the United States of America? And I quote:

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press or the right of the people peacibly to assemble, and to petition the Government for a redress of grievances."

If you need reference, you may find it here at the Official US Constitution Site.

If you are indeed of a mind capable of comprehending such simplistic virtues, then surely you have no further comments or arguments concerning the matter. If you have a problem with said First Ammendment of the United States Constitution, then I suggest perhaps, maybe moving to a different country? There are plenty of countries out there that have no such laws. Of course, they are generally fascist and/or communist regimes where if you say something even remotely in disagreement with the Government, they can torture and kill you and your family. Be glad you live in the U.S. And be mindful to pay respect to its laws.

You people are so hung up on lawsuits and such that you forget your own basic freedoms and take for granted your RIGHTS which over half the world would give almost anything for. You make me sick. You probably aren't even old enough to understand what this is all about, and to you, I say, I hope your mommy keeps you on a tight leash at the Otakon, because she would most certainly object to 90% of the things that go on there. That is, unless, she is busy trying to sue McDonalds that weekend over how fat you got eating their food.

Just give it a rest, it's not worth getting all huffed up over something so insignificant. I could see a problem maybe, and this is a long shot even, if you were being interviewed against your will and painted in a bad light. If these guys were holding you down and making you talk into the camera, and then edited everything together and made it seem like you were the leader of the neighborhood kiddie porn ring, then yes, you have all the right to sue them for libel. But they are just getting people's opinions on Anime here. Not to mention, they get the express written consent of anyone they interview to use them in the documentary. This is how the professional real world works, this isn't Fantasy land where you can spill coffee on yourself and get a settlement for 2 million dollars. That's right, your claims are as asinine as any of the most inane lawsuits you have heard about.

Oh, and at least try to sound a little more convincing when you try to spew forth legal mumbo jumbo about things you are not sure about. Watching 2 hours of Law and Order per week does not make you Chief Justice of the Supreme Court. You can not make up your own laws when there have been fairly institutionalized (though sometimes trampled-on) laws that have been in place for at least a couple hundred years. And as one final note, I dare you.. I double dare you to find me one law, or even a slight bit of legislation that even remotely guarantees anyone the right to privacy.

Show me the incident where anyone said they were going to run around and film everyone if they like it or not. You seem to have this warped view, where you got it from is anyone's guess, that it was someone's intention to sit around with a camera and videotape everyone because they think that every wants to be video taped. Obviously you have hard time comprehending things. Where was it stated that anyone would not ask permission? When was it sated that everyone wants to be on camera? Show me any of the main points you had in a post made anyone. I’m assuming you won’t be able to because you had to be told 5 times to talk to someone else, so I can tell you’re not to quick on the draw.

By the way, because the law is one everyone's side, they can flippantly ignore courtesy, because if you look that word up its definition is 1 polite behavior 2. A polite gesture or remark. Meaning it's the nice thing to do not the obligated, customary or legal thing to do. Being a creature of freewill yourself you could do the same, if you would or not is your problem.
Who is this response to? It followed my post but I'm pretty sure it's not directed against me, right? On the contrery, I never have any problems with documentaries or being interviewed or filed in that manor (Hec, I don't mind at all). My only point is that the documentary be a neutral" view of things..that's all...

Thanks,

Vlad

I don't think anything posted here is ment to be personally against you doing it, It's just due to some very unfortunate incidents with documentaries in the past with the AMV community, that a lot of creators are a bit more cautious and maybe even paranoid. I hope this doesn’t come across that us creators hate being in documentaries or be too discouraging.
Vlad, I do wish to thank you for your open mind on this issue. Rest assured that this documentary is a neutral representation of Japanese culture and will contain no personal opinions of the crew members. All interview questions/answers are completely unaltered and all interviewees are presented as intelligent individuals.
Thanks, That's all I really ask for.. I'm all for good and neutral documentaries!!!

Well, Vlad. You are the only person from this board to show myself or my crew any sort of respect. We thank you for the sentiment but there is really only so much discouragement I can take. I felt personally attacked and after several civil attempts to reason with these people I was forced to lash out...mostly from frustration and discouragment. I am now settled firmly at a point where I wish to never encounter anybody from AMV due to the poor treatment this web board have exhibited. No other web board has shown us any sort of disrespect and I am sorry, but that lowers my opinion of the AMV panel.

Still, it nothing personal against you and should you like a copy of any documentaries we create (for I assure you, contrary to popular AMV belief they are not "fan-docs" altho we are of course anime fans) you are more than welcome to contact us at thecheshireotaku@yahoo.com

AsukaFanGirl wrote:Now, Earthcurrent, you are my next target. Aren't you special with your mosaic idea. Let me ask you this...have you ever taken a camera to a party or similar event? Did you ask EVERY SINGLE PERSON present if they would mind being taped on the off chance that they might possibly end up on film? I highly doubt it. Now, if you planned on showing ANYBODY that footage, then by your own rules, you would have to place a mosaic over every uninformed individual's head. Did you do that?!? Again, I doubt you did.
You are at a con people have paid to attend, not some private "party."
Plus, I'm usually too busy drinking and hitting on girls, be it at a party or con, to bother working a camera. But if somebody comes in and sets up a camera and starts filming in my direction as I'm sitting around drinking and smoozing, they better be nice enough to ask if they can film. Oh, the silliness of your example. You guys are a documentary crew, I don't see why you want us to accept you acting like paparazi.

Anyway, go hump the cosplayers with your cameras since you say they love you so much.

I just wanted to ask something quick... is this documentary, in any way, going to make a profit? The fact that money is involved puts it in an entirely different league, if it is. If this were the case, there would need to be a general advisement put out to ALL con-goers, in written form, before they purchase attendance to the convention. This is only if profit is to be gained. A documentary filming is very tricky legal territory - I, personally, wouldn't want to be in anyone's candid documentary (ALAN... VIC... BURN THE TAPES...). As someone who has shot documentaries legally in a professional environment, there are a lot more legalities involved than simply making a post on a forum.

Of course, if this is non-profit, that's a whole other matter. But the "selling for $10" of the other doc (I'm para-phrasing, of course) seems a bit odd to me.

Just a point from over here, no attacks are intended.

Well, this board does not relect all the creators in the AMV community. In fact, a lot of creators have left for similar reasons. Most of use (I would like to say all) are very nice and friendly. It would sadden me if I could not meet and talk with any fellow anime fans because of an issue as this one. Again, I think most of this reaction comes from past experiences and does not reflect the true personality of many here...
