well, sort of... if you make an AMV using the footage only, the music is what the biggest problem is if that is not original (in the AMV)..NerdStrudel wrote:Funny thing is, if this were allowed on the site it would be one of the most legal things uploaded. It's not actually copyrighted anime since it's fanmade, plus the person who made it fully gives permission, no, he endorses its use.

it still falls under IP laws. Which means using it(without permission and a contract signing over IP rights) is a breach of IP rights.NerdStrudel wrote:Funny thing is, if this were allowed on the site it would be one of the most legal things uploaded. In Summary: I've decided to allow the use of Dead Fantasy as approved footage. It should be noted that the footage is right on the border of what is defined as anime here and the decision is based on the following:
- The videos are based directly of anime approved character (Actually more like replicas)
- The entire concept is directly based on an approved anime title(s) (Final Fantasy, etc)
- There are some borrowed elements that go back directly to the anime
- The creator of it has not objected to its use in an AMV.
Also, based on the current rules we are operating, we do mention:
"There is always going to be a grey area where a judgment will have to be made. We try our best to accommodate creativity and be as flexible as we can".
As we want always want to have some flexibility in grey areas, this is considered a special case and was judge solely on that. This does not mean that every fan made animation will be acceptable here based on this decision, but that each one will be judged on a case by case basis as required. Keep in mind this was already very borderline and so other variants may not be necessarily accepted.

wooooooot, i had been just about to give up hope
and yes i think that with the borderliners like this taking them in on a case by case basis works, i dont think there are too many fan made animations like DF that are animeish enough to be considered similar to anime that it would be a huge problem to look at them one at a time. at least there are not too many yet, that may change in the future
anyway, i'm actually in the process of doing one final edit of my amv thanks to great feedback from some people who got interested in it from this thread, i should have it up by tonight hopefully.
