Question About AMV Copyright

I have read the terms of uploading AMV's, but I have a question. It doesn't mention anything about copyright claims. Example: I made a Kingdom hearts Video, but wouldn't I get in trouble for uploading it since I don't own Kingdom Hearts? (I own copies of the game, but most sites say you have to own the ACTUAL game, but Squae Enix does).

Simple answer. You can basically use anything you want as long as it wasnt illegally obtained. Which a ton of people do anyway... Basically if you want something un illegally obtained you have to buy a dvd or win a dvd in like a contest or something, not like limewire or a torrent. But there are 3 bands on here that arent allowed to be used which are Evanescence, Creed, and one other band.

.. as long as we know where it came from [ a DVD ] and which series [ marked on the DVD/Game itself ] and possibly even the Episode it came from [ Optional ] then if you are having problems encoding it, we have a reference as to your Source and can help you correct "that problem."

Yes, as of now, there has been no legal precedence established that says that you or anyone other than the owner has the rights to make a fan-derived work in the manner specific to AMVing - ergo the legal status of distribution is that it is against the law. However, the site hosting the video (as opposed to the creator) is far more likely to be put in a bad spot if anything were to come of it.

By law, AMVing is basically illegal.

In practice, things are trickier. There are some cases where a copyright owner gets pissed. See the story with Roadrunner records forcing the .org to take down some videos. But then there are other cases. It's pretty well-known that many North American companies that license anime for DVD distribution are "benevolent neutral" - they'll never go on record about AMVs one way or another, but it appears they are all too happy about AMVs as a sort of grass-roots promotion.

Same with the music. The fact that Evanescence singer Amy Lee liked AMVs didn't stop Roadrunner from sending a Cease & Desist letter to the .org, but there are artists and producers out there with much more favourable stances. Just last week I got an email from a favorite musician who found and AMV of mine that used his music, which said the following:

Have no fear. We think it is super cool what you have done and there is no copyright infringement issues on any of it, as you aren’t selling anything.

That's the words I live by, myself.

If you're afraid of The Man though, well, it's your choice! Theoretically there's always a risk, and you just have to accept that risk. In practice, so far, this is not a risk that's proved worth losing sleep over for the average AMV editor.
