HELP plz
so i made and amv and posted it on youtube it was a gintama amv and it was copyrighted does anyone know how to post an amv without it being copyrighted plz help ty

You can't really, it is an amv so it is infringing copyright no matter what you do (supposing you're using copyrighted material, which you probably are) - you just have to be lucky I reckon.

yeah the only truly legal amv is one that uses original animation (stuff you drew up yourself) to some unlicensed music (OC Remix?? but be sure it's not TOO much like the original, or music you make yourself, can even be a direct copy of a popular song! As long as you don't have it playing in the b/g)
BUT it's typically accepted that anime companies, especially overseas ones, don't give a rip, the largest opposition is the use of popular music. That's all I can tell ya, but I think you can take it from there. Also other streaming sites (like our own, or gametrailers.com) are more accomodating to amvs than YT. Advise: Put them where they are wanted and that is NOT YooToob.

To answer the original question, it's actually very easy to get videos restored if they are taken down because of copyright claims on YT. If ever litigated, AMVs would likely be considered fair use under US copyright law, for reasons I have detailed here.
If your video was blocked by the automated filter on YT (which is what happens in the vast majority of cases, especially with the Warner Music dragnet), all you have to do is go to where it says "view copyright information" from your video page and then click the button to file a dispute. After you do that the video is instantly restored.
However, if the video was taken down by a formal DMCA notice, that's a little more complicated. You have to file a formal counter-notice by sending an email with the proper statements to a special email address at YT. Copyright owners then have 14 business days to respond before YT restores the video. WARNING on this though, since this second option does open you up to the [very slim] possibility of a lawsuit. No YT user has ever been sued by a copyright holder over a video they posted, and it would be highly unlikely to happen to you. But there's always a chance, and you have to be prepared to accept that possibility. I myself have used this process to successfully challenge a takedown notice against one of my Final Fantasy AMVs by Square Enix. I filed a take down notice, and three weeks later YT restored the video after Square failed to respond.
So, to answer your question, it is perfectly possible to avoid copyright problems on YT and defend videos that are taken down. You just have to be willing to stick up for your fair use rights at the slight risk of a lawsuit. That's your call to make.
