is the music that is downloaded and put on the music video's legal? could you get sued for downloading them?

Generally, no, the amv makers don't have permission to use the audio. In some cases people will use songs by informal bands, or their own bands, but most of the time they're breaking copyright laws by uploading the audio tracks.

I don't think you'd be sued for downloading. But if you're worried about it, you're safer not watching or making amvs.

/There are lots of threads about legality in the "General AMV" section. Feel free to skim over the last few pages - you'll see them. They pop up once or twice a month.
