If AMV's were in trouble...

Post by Nagii » Wed Jan 25, 2006 10:35 am

I was just reading some threads I found here on the .Org but I couldn't reply to them so I started a new topic.

How many people here think if the RIAA attacked people about AMV's, the .Org and so forth if the Anime companies whom just let us would back us up. I mean it's not like the RIAA is fighting random downloaders, there is alot of AMV creators... not only that but Anime Conventions too.

Truthfully, it is not illegal in Canada anymore. A law was passed that it is fine as long as it's for personal enjoyment and not for finaincal gain.^^

All that stuff I said about Canadians being weird I take that back. lol. I like that law. As long as it is not for financial gain. Anyways I don't think amv's are in trouble right now. As long as other creators and people who download them don't go to the record label and say hey did you guys make these? For that is the dumbest question you can ask.

NONE.

It's obviously NOT in their financial interests to go toe-to-toe with the RIAA over some stupid hobby.

If you are referring to http://laws.justice.gc.ca/en/C-42/39673.html#rid-39787 , that is invalid for two reasons:

(1) That law applies only to private copying, which you are clearly not doing by, well, public distribution.
(2) I'm no lawyer, but I don't think you're merely making a copy. You are making derivative works. This law, if applied strictly, does not apply to derivative works -- only "all or any substantial part of" of specific types of sound recordings.

If not, well, link it. I have a very hard time believing that any government would permit its citizens to produce and freely distribute works derived from copyrighted material without the express permission of the copyright holder, whether granted in terms of copyright or written agreement.

Post by amvwizard » Wed Jan 25, 2006 6:38 pm

its gonna suck if they shut down the .org dude i think i would seriously cry

what we should do if that happens is put all pur amvs on bittorrent or limewire and places like that and then just have a site that tells about the amvs but not have the amvs on it

I've said this several times before.

IF THE ORG WAS IN TROUBLE IT WOULD HAVE BEEN SHUT DOWN ALREADY! Stop whining because 3 bands can't be used anymore.
