Correct me if I'm wrong but:

Distributing Pirated software is pretty much the same thing. Even if you aren't charging money for it (non-profit) it's still not personal use.

And with AMVs you are distributing copyrighted anime and music.

Exactly - google is just doing its due diligence so it doesn't lose safe-harbor protection. The RIAA can still hit you for up to $150,000 per song uploaded if they wish.

I have some with ads too, I prefer that to having to mute them LOL

WMG is going to feel that loss soon, as anyone I know sends youtube links when they show me a new song. I don't see WMG getting their music out to anyone one in the future.

That's the american law for fair use. Other countries have different laws. For example, in Italy, we have a much stricter "fair use" law. It only allows to share low-quality copies of edited material that includes copyrighted material in the case it is for scolastic or scientific purposes. So AMVs have no fair use cover in any way. OTOH American fair use is broader, so things that heavily change the original meaning of the original thing are covered - I guess AMV Hell is a good example of what could be covered by fair use, considering that it pretty much changes the original intent of both the audio and video. But the usual AMV isn't really covered by it, generally speaking.

Also, non-profit isn't doing something without any income by a private... have a read. It doesn't fall into personal use either since you're sharing. It isn't even educational for obvious reasons. So yeah, the balance isn't really tipped in favor of fair use.
