Well, 10% actually :P (assuming you don't include using more than 1 anime per audio track, don't calculate the amount of anime you can legally use, the "value" of specific scenes which has an impact on legality, the various licenses that each source may be using, oh and trythil's opening using blender which is 100% legal unless there's a very similar scene out there which someone has some sort of copyright on)
I'm not a lawyer, but I don't think it's totally legal.
The only objects in that opening that I did not create from scratch were the images of Haruka. They aren't directly from Noein, as they were redrawn by me, but I think that might put it into the fanart arena, and I am not familiar with the legality of that.
Pessimistic answer: No, it's not legal, because it's an unauthorized derivative work of Noein.
Real answer: I have no idea.
