(1) an H.263 video stream in an AVI container
(2) an H.264 video stream in an MPEG-4 container
(3) a Theora video stream in an Ogg container
Open Source / Free Software encoders and muxers exist for (2) and (3). Indeed, (3) adheres very strictly to the definition of "free format".
Both (2) and (3), however, are relatively difficult to manipulate compared to (1); this is not because of any NDA, patent, or other legal device, but simply because the tools to manipulate them aren't as user-friendly as the tools for (1). (You can muck around with (1) in nearly any video editing application. Not yet quite true for (2) or (3).)
This difficult has the side effect of keeping some people from "stealing" your footage, if you're concerned about that sort of thing. It won't stop everyone, but it'll stop those without the motivation to go further.

People sell DVDs all the time, ne? Difference is, they're making money on their own editing effort and not others'. That's what's icky.
Stealing for free is merely pathetic. My Only Video Worth Mentioning(tm) was plagiarized and I could only laugh. It probably took them longer to chop my credits off and drool out an entry on YouSuckTube than it took me to make the damn thing in the first place.
