An anime distrobution site wrote:As per the Berne Convention, any substantial distribution of copyrighted material produced within the union (the signing countries, that is) is illegal. This is a cold hard fact. Exactly how the signing parties have implemented this in their laws vary according to, among other things, their concept of fair use. The convention states that the copyright holder should have the right to prosecute to recover damages done by the person or organisation performing the copyright infringement. It does not mandate that the state should prosecute such crimes, but neither does it prohibit it. As always, your mileage may vary.
In any case, people participating in filesharing could potentially be a target of prosecution in many countries. In some countries, even linking to copyrighted materials is illegal, and in such jurisdictions a site like this **bleeped**(anime distrobution site) would be illegal.

It's almost certainly illegal to use. You would have to have written permission from all of the copyright holders to make it legal.Scintilla wrote:It's not really illegal to use; it's just frowned upon.
You didn't legally download it. Copying without the permission of the copyright holders is against the law regardless of whether the series has been licensed by a North American distributor or not.Calim wrote:Ok so If I legally download an anime episode for Naruto...
Yes, it's possible to sue someone for copyright infringement in another country. Look at Dmitri Sklyarov - sued in the USA for breaking funky US copyright law, despite that his actions took place in Russia where they were legal.Calim wrote:How would one be able to sue someone in another country? Is that even possible?
There are ethical issues relating to fan distribution of anime and anime-derived work, and there are legal issues. If your actions are ethically acceptable, I won't fault you for them. But please don't spread the belief that copyright infringement is legal. It is not. The law is wrong, but it is still the law. What's going on here is civil disobedience - people deliberately breaking the law because the law is wrong.

Koronoru....did you even read the rest of the thread? Yes? Then you must of missed the part were they already proved me wrong, not that I don't appreciate your opinion in all of this...
BTW!

I never meant to spread the belief that copyright infringement is legal...how do you say I was unfamiliar with International Copyright laws and the fact that they had them and it affected the uploading/downloading of anime from japan. But please don't spread the belief that copyright infringement is legal. It is not. The law is wrong, but it is still the law. What's going on here is civil disobedience - people deliberately breaking the law because the law is wrong.
