Anyway, I think when you use footage you own, especially when it's Anime, the companies won't do anything against you, because basically you are promoting their work. It's like they tolerate fansubs and such.

Hmmm...I wouldn't be as strongly against downloading anime for AMVs if people regularly only made footage available and removed the soundtrack--therefore not making available a whole "product". And second, only if they made available footage of shows that aren't available on DVD outside Japan. Saying, I'm poor, I can't afford to pay for DVDs and therefore must download is a copout. Being an AMV creator can be relatively cheap, or expensive depending on how you go about things. Yet, if you can't afford your hobby, then you should get a job to support it and stop bitching.

seriously though if you were a anime company would you be more likely to go after the people trading the footage .... or the people ripping it?

I'm saying that it's still illegal to buy DVDs and distribute them in the form of AMVs just as downloading is, whether it's the video or the audio. And I don't think it's a copout I think people should be able to have this hobby through those means if they wish, just that they should respect the rules Phade has set and not associate them with this site.

And about the anime companies going after people, I don't think either people are really at risk, but that's not what we're arguing...

If I wanted to make a dent I would go after the most publicly visible indivuals: the traders. Shut them down, make a big hoohoo about it in the media, and hope that other traders get spooked and shut down or go underground where they aren't as visible and available for some Joe on the street to use.

Yeah, I agree with you, that's how the Berne Convention is laid out. And as a result I'd prefer to try and keep things as close to "legal" as we can in this communitee, especially the way the MPAA and others in the entertainment industry are thumping the wardrums in regards to violations of copyright laws. Also, with larger studios moving into the realm of anime distrubution, copyright issues are something we should be genuinely concerned about as these larger companies have the money and time to spend on go after people they feel are violating their copyrights.
As a result, having a code of ethics and a willingness to follow those ethics is indeed a good thing for this community. And the reason I'm against digital distrubution online is simply because ethics are all to easily thrown out the window.
