Just wanted to quickly say that it is Youtube and I made a typo. ANd it's kind of weird to see everyone replicating my typo.

Also, this guy seemed to sum it up nicely:

Personally, Geo, I think you're the only one on Gaia, nah, probably the planet, with such a narrow sense of reality.

If Phade did not remove the videos, he would have been taken to court, and the website shut down. Now, maybe I'm alone in this matter, but I think that it's better to have the .org around and all of the other AMV's up, than trying to fight it, losing (because you can't win when you're technically violating copyrights), and having the site shut down completely.

On second thought, I know I'm not alone in my thinking on that. However, Geo, I think that you may be alone in your thinking.
And Koop.

You make an excellent point.

Hah, what a jackass. He is an asswipe for calling Phade a "Spineless Worm," and should be shot. I was a little pissed when a-m-v.org had to ban Evanescence videos, and other bands. But I was'nt pissed off at phade, oh no sir. I was more pissed off at whoever wrote to windup asking if they made the video.

This individual needs a reality check. :x

Despite the .org's flaws, its still a very good AMV community. :)

For Linux, I believe VirtualDub is a workable solution, though I admit I've never used it.

I think that's all I have to say about that.

---

So I'm sure someone remembers my hard-ass stance of "fuck Wind-Up Records". I'm still holding myself to that and I still think anyone who think they did something wrong to also do that.

I don't think Phade did the wrong thing, though; and, for the record, he didn't order anyone to shut up about Wind-Up. Suggesting it isn't the same thing as ordering it. If you look back, you'll notice that all of my posts on that topic still exist; I think that makes a pretty clear point.

Some other stuff:
SQ wrote:If the label didn't do anything, they would have lost the copyrights for the bands.
This is not true. Copyright, at least in the U.S. and many European countries, exists by default whether or not the owner chooses to enforce it. Trademarks have to be enforced.
Geo wrote:It IS possible to win these cases against the copyright holders. It's just that nobody ever actually tries. Get a judge to rule that AMVs fall under Fair Use, and that stuffs a big ol' cork in Creed's mouth pretty quick.
Such an action would indeed shut Wind-Up up pretty quickly.

Unfortunately, fair use is also extremely expensive and time-consuming to establish. There are no hard-and-fast rules in the U.S., which is pretty clear from a reading of U.S. copyight law. It has to be decided in court. That's why nobody -- except for the extremely rich (and, perhaps, extremely bored?) -- relies on it.

There's a substitution rule that changes it to "youtub".

Well, dude obviously has no sense of reasoning. Just because he's a big risk taker doesn't mean that Phade has to. Now, I don't know much about running your own website, but if Phade puts up that much money just to keep this site going for the rest of us then he can do what he wants. Besides, he had the other members interests in hand while making the decision adn Shoroo_Lupin already said it best. I don't have any complaints because I have other videos that are still here. Just let go off to what he wanted to do. He won't get as much feedback for his stuff as he would here.

Somehow I'm getting the impression our idiot friend (I got a good laugh out of the 'VirtualDub on Linux' as well) is probably someone permabanned from here. Who was it that was constantly claiming the FBI wouldn't ever go after them because they were scared of him?

What I meant to get across was that they could have uploaded it to an alternative host that wouldn't take it down, so when the original file was lost, there would still be a copy. This goes back to the point about there being alternatives to a-m-v.org. Assuming the file is lost in a crash either way, it's better to have it uploaded to a host that will keep it around instead of caving to industry pressure and taking it down.
i don't think phade actually deleted any of the videos that were taken down... they links are just removed via code.

That guy is a f($*#)@ a$(#h()#. He has no idea how lucky we were to get off with a minor slap on the wrist by removing the links.
