That site is bull. They are giving the minority opinion from the 9th Circuit Court's decision on Napster, which actually ruled in FAVOR of Napster's continuation. 
From the opinion:
"The mere existence of the Napster system, absent actual notice and Napster’s demonstrated failure to remove the offending material, is insufficient to impose contributory liability."
In other words, Napster is fine. It's the users that might get in trouble. Same here. The .org is fine. Individual creators might get sued though, but I don't think RIAA want to open the 'fair use' can of worms any more than it already is.

From the opinion:
