About Copyrights?

I was going to an intense reflection about life in general when I asked myself if AMVs break copyrights. I tought you nedeed a license to have the right to use a copyrighted music and movies. And I think anime are copyrighted, I'm sure music and movies are, so is it like legal if you don't sell them or maybe they are considered parodies. Cause I know parodies are legal... Well some are.

Yes AMV are "illegal," at least for distribution on the web, a la the carrot, etc...unless you get permission from the video and music copyright holders to use their materials. If you make videos for your own private enjoyment you aren't technically breaking copyright laws, though some might argue about this.

The thing that keeps AMV creators from getting their asses sued off by the anime companies is that most of the anime companies are run by people who were once and still are members of the fan community. They see AMVs as an integral part of anime fandom, as well as decent advertising for their products. And, so long as AMV creators aren't trying to make profit from their videos, regardless of how they try to justify it, I see no reason for the relationship to change.

the companys dont really care that much unless you try and sell your vids, or someone else's...doing so should get you beaten full metal jacket style

The real reason we aren't sued into oblivion is that the RIAA is currently busy trying to shut down P2P programs and going after the occasional college student with a stray mp3 on his harddrive for millions of dollars in damages. Really, a 50MB file with the latest boy band sensation's hit single isn't as much of a concern as the 3MB mp3 with the same song. If, by some miracle (or, rather, it's demonic equivalent) the RIAA succeeds on putting the mp3 gene back in the bottle, then you can expect this community to get hit with the "Cease and Dissit" letters.

You know what? The RIAA doesn't give a fuck about us because they don't even truly know we exist. Maybe 1% of the professional music community realizes there's such a thing as Anime Music Videos. You know what? They don't give a shit. Why? Because we're nobodies. ALL OF US. We're a bunch of fucking geeks having fun with our computers. I think it would be great if the RIAA one day decided it would try to stop AMVs in any form. That would be great. It would mean free publicity. I HOPE the RIAA tries to sue me. I'll end up on CNN and become a movie of the week.

Of course, it won't happen because, once again, NOBODY GIVES A SHIT THAT A BUNCH OF GEEKY ANIME FANS ARE MAKING VIDEOS. I used Gimme Shelter in a wedding video once. I got paid for that It was illegal. I DIDN'T GET SUED. Unless AMV creators start making buckets of money - I'm talking at LEAST over $1k/month - the RIAA will never care. Video artists have been using copywritten music in their videos since the early 70s. They haven't been sued yet. Don't worry about it. It doesn't matter until it happens. If someone does get a cease and desist, it'll be a warning. No one is in danger. So stop asking the goddamned copyright question.

Once a month, right on time, same fucking thread that get's the same bullshit answers from people who have never actually had to deal with this shit... you're not a rebel! You're not cutting edge! You're a FAN!

Obviously you haven't been paying attention to the RIAA's current tactics. Don't worry though, the RIAA is looking to gain the power to hack into your computer (even though they are not a law enforcement entity) and delete all files they don't like. So we won't have this problem anymore. Instead, we'll just have the occasional thread pop up where someone cries that the RIAA deleted the vid they were working on for the past three weeks.

:shock: Hurrah...according to Nightowl we can occasionally charge people for our AMV 'cause no one will care...or maybe this is just messed up drunken logic that will later be taken back...

And here I wanted to get paid to do my hobby...
