Copyright Infringment?

Post by V3n0m » Fri Feb 28, 2003 2:29 pm

I recently posted my website up Via Internet Solutions, they've been helpful its only 7$/mo for 300 meg, and it's a .com on top of that

My problem is a week about after i posted my site on the server i got an email notifying me of copyright infringment, i have no idea what it's from being that i created the site from scrap pix on my second HD, i posted a few of my music videos, and yeah

WTH could i be infringing on, i've made disclaimers, a privacy policy, and gave credit to Funimation, Yipee i dont understand
i've gotten the idea it's form using DBZ Pics, but it's a fansite, so wtf
I've gotten the idea it's from using popular music but u guys do it
i'm thinkin on goin thru my school maybe get lisencing information on various anime and market my vids on dvd if at all possible, otherwise just the site, but can somebody please tell me wtf could possibly be the problem?

I was afraid to post my site after they took it down a week after i posted it, then after that the next week they took the DNS down, i have no idea what the hell is going on, i just want a freekin fansite with my vids on there but red tape always occors with me i guess if anybody could help it would be greatly appreciated

If your pulling alot of bandwidth, chances are the hosting companies aren't making a profit off of you and will shut you down while giving you a bullshit reason of copyright infrignment.

Its happen to me before with places like TITAN hosting and bluedomino.com

And for 7$ a month, its not even worth quality hosting. :?

Yeah, they pull that copyright infringement stuff out when you start using a lot of bandwidth.

It's not the total storage space you have to look at when finding an ISP it's how much bandwidth they will allow you to use.

Also be aware that "unlimited" bandwidth doesn't always mean "unlimited transfer." Many places get petty when you exceede 30 gigs in a month. But with AMV's it's easy to exceede 30 gigs in a day. So watch your statistics ....

AMVs are clearly a derivative work based off of copyrighted material. The only party that has the right to authorize, make, and distribute derivative works is the copyright owner. See Chapter 1, Section 106 of U.S. copyright law.

Everyone here who distributes (or even makes) AMVs is breaking the law, unless they (1) cleared the video with the animation studio and the record labels or (2) made their video with 100% original material (and I know that many people here don't do either). Usually, people don't care, but when you start drawing a lot of throughput...

Well, in any case, your ISP was fully within its rights to shut you down.

So Wierd, i just put my site up then they take it down, i've barely had any hits, it's pissin me off that they rip my whole site down for a few files, then they refuse to tell me the names of the files, or even the extensions, i looked a couple days ago and my DNS is gone, my DN, but the server is still up, I'm beginning to think a Fansite is illegal in the eyes of Funimation and the US government, just because of how jewish they are ending up to be, gov. exspecially

First off, learn how to spell.

Second, they aren't gay.

The host probably gave you the copyright infringement notice because you're using too much bandwidth. Otherwise, that host is real gay.

First off, don't throw stupid slurs like that around.

Second, it all comes down to freely available copyright law. You should have known what you were getting into when you started making AMVs.

If you didn't know, it's your fault, and nobody's going to pity you for losing your hosting.

When you choose a web-space provider, you agree to their terms and conditions. They are a private entity, and therefore not only have to abide by federal copyright law, but are also allowed to do whatever the hell they want with their property.

You are storing your data on their property. If they sense it as a threat, they will do whatever they can do to remove that threat, and it is fully within their rights to do so.

Don't like it? Too bad. Go set up your own server, or find somebody more willing to host illegal video files.

Many free and cheap providers also make a provision which says sites can't put up any video or music files (due both to copyright and possible bandwidth). That may also be why.

well to piss them off you could put up a new site with one big uncomressed AVI and then we could all take turns downloading it with a download accelerator. How much would that piss them off? Just make usre the vid is of something that isn't copywrited, make 300 megs of blank footage in premiere and then put it up on your site or something like that.
So in other words, one part of the community is waging war on another part of the community because they take their community seriously enough to want to do so. Then they tell the powerless side to get over the loss cause it's just an online community. I'm glad people make so much sense." -- Tab
