About using other people's footage

Postby Al'x » Fri Nov 04, 2005 10:23 am

Would you be angry if somebody used very large amounts of your video, or made a video with the only source being your video, but they changed stuff like adding effects and changing scene order to make it better, as long as they put you in the credits (but did not ask permission)?

What if they did the same thing, but did not change any of the editing?

Or, even worse, what if they edited your video in such a way that it is much worse than your original video?

Or what if they took all the footage from your video which you put so much hard work into and made it insulting to the original video?

I'm kinda curious to know. Because all of these things are allowed under the site rules right?

Funny you should mention this topic, just yesterday i spotted this video: http://www.animemusicvideos.org/members ... d_id=95169

The part between 3:31 to 3;37 was taken directly from my Naru-85 video. (And thats would have been a toughie to prove if he split up the scenes since I don't use any effects or watermarks, but he managed to lift an entire segment containing 4 different animes with my edits.)

Ok, its not a 'large' chunk or the whole video. I probably would have been super pissed if he did that and then tried to claim the whole thing as his own work. Actually, I'm rather flattered at this moment that he thought enough of my video to want part of it. :)

I noted that the scenes he took from mine were some of the better-quality clips in his vid...except he did a crappy job of encoding and left an ugly divx logo on the thing. I'm tempted to tell him how to dump that thing...cluttering up >my< clips<. :x

Still would have liked a little private note from him though or an acknowlegement of the contribution. Maybe he's still holding out for 'plausable deniability'.

As far as the site rules go, that is still a grey area. I've heard and seen the threat to drop blatantly pirated vids but I'm not sure if anyone has actually been banned over it. I am not going to even touch the legal argument of the origin of footage.

If anyone respected one of my videos enough to want to make a whole video insulting it, I'd be quite interested to see the result. 8-)

... as long as they gave me credit somewhere.

As it just so happens, I'd reckon my three most popular videos are pretty hard to get away with using for <s>porn</s> source: one has near-constant subtitles (added by me), one is AEO:EB, and the third has near-constant blinding effects going on.
No, this was not an intentional design decision on my part. :P

Yeah, I'd be upset. Especially if the footage itself was costly to obtain or difficult to clean. For example, when I edited with Cossette it wasn't yet released in the US, so I shelled out about $200 to import it. Likewise, I've heard of a guy who paid nearly $1,000 to purchase all of Rose of Versailles on R2 DVDs, so that he could obtain high quality for his video. So if someone came along and ripped off that footage, I could see him being angry, and rightfully so.

It's happened to me about 3 or 4 times, and the first time I was pretty furious, but then I realized that the rip off vids aren't very good anyways and never get any recognition. I'd prefer to never be credited in those instances becaue it'd make me look bad.

I'll say it again..

When someone steals your footage, you know you've made it.

its a double edged compliment,

where on the one hand it annoies me to see frankenstens, and makes me want to puke at the laziness,

on the other hand someone liked my footage enough to rip it off...

I dont mind if none of my edits are in there, but if I can turn the volume down and hear my music video in my head, thats just pure laziness.

its happened to me about 4 or 5 times already, I dont stress it too much anymore, but I usually contact them to let them know that they just made themselves look like a lazy bastard.

When I catch another member's vid being ripped off I usually notify them so they can deal with it in their own way.

no...

someone stole footage from my sailor moon videos long long ago, and i still havent "made it" to your standards of "making it"....

and as for someone stealing your footage... leave em an op, thats what i did, i posted in the op that "i would have given you the high quality version if you had asked me, but i dont like you ripping my footage off and giving me no credit at all, i had to capture the footage from vhs, so for now you get a low score, if you reply back to me on the forums we can talk about it"

they then PM'd me back and we worked it out, i fixed my op, they credited me by saying "using footage from amv_4000's My December music video" and all was good in the world...

If they gave me credit, I would accept it. I wouldn't like it since I'm easy to contact and quick to give permission to those who ask, but I'd accept it. Permission is an email away, credit is a single name (a link if the person is feeling gratious). I see it as laziness not to try getting permission - the real question would be whether it's okay to use the source with credit given when the original creator says 'no'.

I don't find it flattering when someone who has my vid listed in her favorites uses that exact vid to a different song and claims sole credit for it. It's the same way for people who review a vid and then I find out they used that vid for their own benefit - backstabbing, a "I'm your friend but only because I can use you" treatment. If it's common enough you reach the point where you don't even want to know and just stop downloading likely frankensteins.

Org policy is to delete obvious copy-cat vids. I don't know what the policy would be for vids that cite the sources because most creators taking clips/vids try to get sole credit for the work.

Parody videos are different - if the purpose is to mock the original video, then it's dependent on the viewer *knowing* the original video. These aren't taking credit for someone else's effort - if they were, it wouldn't be a parody vid. They should still ask permission if they're using actual scenes from the original, or at least be sure to cite the sources rather than assuming the viewer will be familiar with the original. It would be simpler if they just reproduced the excerpts with recognizably similar editing and fresh source footage. If the editing is so difficult they can't reproduce it, they have no place mocking the video to begin with. In that case, they can get permission or wait till they learn to edit better.

if they clearly credited me, i couldn't feel hostile about them using my video without feeling like a hypocrite.

I wouldn't mind at all. After all I'm already using someone else's creations(source anime/music) while I make my AMVs. If there's no editing in part of my AMV that got ripped, then it's no different than using the original footage. If there's some editing/fine-tuning done then I'd be quite honoured that someone found something useful from the stuff I made. If this is done, then only thing I'd like too see is me getting mentioned/credited in some way, be it the AMV itself or video description or whatever. I don't demand this (since, really, I don't mind) but it would be proper and polite thing to do.
Though I'm not in the position to say all this since my AMVs are still mostly unknown and something people won't bother ripping  If something like this happens I'd be more like curious to see what they have done with it than be offended by it.

Way other thing is when someone just takes the AMV, makes a new entry with it and claim it as his/her own creation. That's just sad :(

No.

First: I probably wouldn't know.

Second: Even if I did know, I just don't care. There's other things that I have to worry about proper authorship on, and AMVs isn't one of them.

Third: I agree with Castor Troy. If someone likes your footage enough to rip it off, that's a compliment more than anything.

Well... as most said, I guess some proper crediting will stop me from throwing a fit... well, I'm really not the kind of person that throws tantrums, but you get the picture.

I've currently been churning on the idea of getting all the videos which I've made to be authorised by the licensing company in my country (namely Madman Entertainment)... I know one of the head guys and they've granted me permission to use their DVD titles previously so long as I credit the company for it... now when I get around to actually getting this formalised, I think I'll be a tad more pissed if someone ripped my work after I've gotten authorisation for them...

Now it's on to getting permission for the music :p

First i'd be confused. Both that i downloaded a random video and could watch more than 15 seconds of it without the urge to turn it off, then even more so regarding the fact that someone would actually use clips i made. After getting over the initial shock, i'd make sure it was my work and drop a little note to the mods. If they vid is still up on the site after a few weeks and i have any interest left i'd leave a scathing yet lengthy (and more importantly "honest and to the point") review and urge others I know to do the same.

Most likely though, I wouldn't get past step one.
