because you can at least claim ownership ... that it was a backup copy for personal use.

If you're circumventing copyright protection systems to make that backup, you're still guilty.

And won. Backups for personal use don't lose lawsuits, illegal or not. That's why there's so many software companies that accept American Express for selling CD-Protection-breaking ripping software and they don't get busted.
